3. Customer Responsibilities
Before work begins, you must inform us of any known issues, modifications, previous tuning, repairs, warning lights, mechanical faults, accident damage, or other relevant information relating to the Vehicle.
You confirm that:
1. You are the legal owner of the Vehicle or have permission from the owner to authorize the work.
2. The Vehicle is legally in your possession and is not stolen or subject to any restriction preventing the requested work.
3. All information provided to us is accurate.
4. You have disclosed any known mechanical or electrical faults.
5. You are responsible for ensuring that the Vehicle remains legal for road use following the Services.
6. After the unit is returned, the customer is responsible for using 89 Octane fuel.
Failure to disclose relevant information may affect the performance, reliability, or safety of the vehicle and may invalidate any warranty or guarantee provided by us.
4. Vehicle Condition
Tuning and remapping can place additional load and stress on an engine, transmission, turbocharger, clutch, drivetrain, cooling system, fuel system, and other components.
We will use reasonable care when performing the Services. However, we cannot guarantee that an older, worn, modified, poorly maintained, or mechanically compromised Vehicle will tolerate increased performance.
If a pre-existing fault becomes apparent during or after the Service, we may recommend that the Vehicle be repaired before further tuning work is carried out.
We are not responsible for failures caused by pre-existing defects, wear and tear, incorrect maintenance, abuse, overheating, poor-quality fuel, aftermarket components, previous modifications, or other circumstances outside our reasonable control.
5. Performance Results
Any horsepower, torque, fuel-economy, acceleration, or other performance figures provided by us are estimates unless expressly stated otherwise.
Actual results may vary depending on:
● Vehicle condition
● Engine specification
● Mileage
● Fuel quality
● Environmental conditions
● Dyno type and calibration
● Existing modifications
● Tires and drivetrain
● Manufacturer tolerances
● Software and hardware variations
Unless specifically guaranteed in writing, quoted performance figures are not guaranteed.
6. ECU Software and Original Files
Where appropriate, we may create, modify, store, or install ECU software or calibration files.
We may retain copies of original and modified files for backup, quality-control, warranty, and future servicing purposes.
The customer must not reproduce, sell, distribute, copy, reverse-engineer, or commercially exploit any proprietary calibration, software, map, or file supplied by the Company without our written permission.
7. Software Compatibility and Vehicle Modifications
The customer must inform us of all aftermarket modifications and previous software changes.
We are not responsible for problems resulting from:
● Previous tuning or remapping
● Non-standard ECU software
● Aftermarket engine components
● Non-standard turbochargers or injectors
● Performance exhaust systems
● Air-intake modifications
● Faulty sensors
● Non-standard transmissions or clutches
● Poor-quality or incompatible aftermarket products
● Modifications carried out by third parties
Where we identify a potential compatibility issue, we may refuse or postpone the Service until the issue has been resolved.
8. Mechanical Failures
The customer acknowledges that increasing engine performance may increase mechanical and thermal loads.
We are not liable for consequential mechanical failure of an engine, turbocharger, gearbox, clutch, driveshaft, differential, fuel system, cooling system, or other component where such failure results from an existing defect, wear and tear, inadequate maintenance, previous damage, aftermarket modifications, misuse, racing, competition use, or other factors outside our control.
Nothing in these Terms & Conditions excludes liability that cannot legally be excluded.
9. Motorsport and Off-Road Use
Certain tuning products or modifications may be intended solely for motorsport, competition, track, off-road, testing, or other non-public-road use.
The customer is solely responsible for determining whether the Vehicle and modifications comply with all applicable laws, regulations, inspection requirements, insurance requirements, emissions requirements, and road-use restrictions.
The company does not authorize or encourage unlawful use of any Vehicle or Service.
10. Emissions and Road-Legal Compliance
The customer is responsible for ensuring that any modification or software installed on their Vehicle complies with applicable emissions, environmental, inspection, roadworthiness, and other legal requirements.
Where a requested modification would be unlawful in the jurisdiction in which the Vehicle is operated, we reserve the right to refuse the work.
We do not guarantee that a modified Vehicle will pass any particular emissions test, inspection, roadworthiness test, or regulatory assessment unless expressly agreed in writing.
11. Diagnostics
Diagnostic services are intended to identify potential faults based on information available at the time of testing.
A diagnostic result does not necessarily identify every underlying mechanical or electrical problem.
Additional testing, dismantling, repair, or inspection may be required to establish the cause of a fault.
Diagnostic fees remain payable even where the underlying fault cannot be conclusively identified.
12. Warranty
Any warranty offered by the company will be subject to the specific warranty terms provided to the customer.
Unless expressly stated otherwise in writing, our Services do not constitute a warranty against mechanical failure of the Vehicle.
Any warranty may be invalidated by:
● Subsequent modifications
● Additional tuning
● Abuse or misuse
● Competition or racing use
● Failure to maintain the Vehicle
● Use of inappropriate fuel or fluids
● Tampering with the software
● Repairs or modifications by third parties
● Continued operation of the Vehicle after a warning light, fault, overheating, or other serious issue
Nothing in this section affects statutory rights that cannot legally be excluded.
13. Parts and Third-Party Products
Where we supply or install parts manufactured by another company, those parts may be subject to the manufacturer’s warranty and terms.
We will, where appropriate, assist the customer with a warranty claim but are not responsible for manufacturer defects outside our control.
14. Quotes and Pricing
Quotes are based on the information available to us at the time of quotation.
If additional work is required because of an unexpected fault, incompatible modification, damaged component, or other unforeseen circumstance, we will notify the customer where reasonably practicable before carrying out additional chargeable work.
All prices are subject to applicable taxes unless stated otherwise.
15. Payment
Payment is due upon completion of the Services unless alternative payment terms have been agreed in writing.
We reserve the right to withhold release of the ecu until all outstanding amounts have been paid.
Deposits or booking fees may be non-refundable where stated at the time of booking, subject to applicable consumer protection laws.
16. Cancellation and Rescheduling
Customers should provide reasonable notice when cancelling or rescheduling an appointment.
We reserve the right to charge a cancellation or missed-appointment fee where this has been clearly communicated before booking and is permitted by applicable law.
Any statutory cancellation rights applicable to consumers remain unaffected.
17. Customer-Supplied Parts
Where the customer supplies parts, software, components, or other products, we are not responsible for defects, compatibility problems, incorrect specifications, counterfeit products, or failures attributable to those items.
We may refuse to install or use customer-supplied components where we consider them unsafe, unsuitable, defective, or incompatible.
18. ECU Storage
We reserve the right to charge reasonable storage fees for ecu left at our premises beyond the agreed collection date, where permitted by law.
20. Data and Customer Information
We may retain information relating to the Vehicle and Services provided, including vehicle identification details, diagnostic information, software versions, calibration files, dyno results, and service history.
Personal information will be handled in accordance with our applicable Privacy Policy and data-protection obligations.
21. Limitation of Liability
To the maximum extent permitted by applicable law, the company shall not be liable for indirect, consequential, or unforeseeable losses arising from the Services.
This may include loss of use, loss of income, loss of business, loss of profits, or consequential damage.
Nothing in these Terms & Conditions excludes or limits liability where doing so would be unlawful, including liability for death or personal injury caused by negligence where such liability cannot legally be excluded.
22. Force Majeure
We will not be responsible for delays or failure to perform Services caused by circumstances beyond our reasonable control, including natural disasters, fire, flood, power failure, supplier delays, equipment failure, industrial disputes, government action, or other unforeseen events.
